Thanks for visiting the Silent Sounds website. Please read the terms and conditions carefully before placing any orders. Silent Sounds reserves the right to modify the terms and conditions from time to time and without notice. If we make a change, the next time you visit this website will mean you agree to the amended terms and conditions.

Hire Conditions

  • By agreeing to hire equipment from Silent Sounds, you agree to the following terms and conditions. Silent Sounds undertake to provide you with the equipment you have requested, in working order, on the date(s) you have booked.
  • To ensure your function, event or party is a hit, take the time to check all the equipment when it has been delivered. You will be responsible for all the equipment once it has been delivered to you until it is returned to Silent Sounds. All equipment provided including headphones, transmitters, storage containers, cables and other AV devices need to be stored securely and returned in the same condition as they were on delivery.
  • You will be responsible for the safekeeping and condition of the equipment and it must be returned in the same condition as it is received.
  • Silent Sounds ensures all equipment is checked, charged, cleaned and counted before it is delivered. Headphones will come pre-charged with approximately 10 hours charge. Should any equipment not be packed or working upon delivery, please contact Silent Sounds immediately, so we can assist. We strongly encourage all customers to set-up and test equipment within opening hours. In the event of issues in set-up/operation, we advise to contact the Silent Sounds team for troubleshooting assistance.If you experience a suspected pre-existing fault with our equipment, we encourage you to contact us within business hours to allow for our customer service team to try and diagnose the issue with you. In extreme cases, we will make a note to inspect the equipment upon return and can organise a credit/refund for the item/s of equipment that demonstrate a pre-existing fault. We also strongly encourage you to contact us if you believe you have caused damage to any of the equipment during the process of hiring as this will allow us to perform an efficient fault diagnosis upon return resulting in a quicker return process for you.Silent Sounds reserves the right to not issue a refund if nothing is reported at the commencement of your event.
  • Costs – We request payment of the full amount including bond to confirm your booking. Typically we ask that all invoices are paid within 14 days of confirming a booking, or earlier if your booking is closer than 14 days. Payment of all invoices is requested in full and via online bank transfer or by card payment via stripe. A minimum bond will also be required for bookings. This bond will be returned to your nominated bank account within three (3) business days after the return of equipment provided all equipment is returned in full working order. Please note – for bookings at peak times (e.g. public holidays, New Years Eve) we will request payment of the full amount including bond by the due date of the invoice, otherwise the booking will not be secured.
  • Damage or loss of equipment – We understand that accidents happen sometimes, however if any headphones, transmitters or other equipment and cases are lost or damaged making them unusable you will be liable for the replacement cost. The cost of replacement will be $90 per headphone and $250 per transmitter, and will need to be paid before the bond is returned. Additional costs may be charged for damaged or missing equipment (e.g. disco lights, power cords, cables, ear coverings, etc) or if significant cleaning of equipment or cases is required, outside of the usual use. Should debt recovery be required, collection costs will be charged to the client. The best way to avoid this cost is to ensure you and your guests look after the equipment. For organised events we highly recommend utilising an enclosed space to ensure the safety of the equipment. Any loss or damage to headphones and other equipment at organised events (with or without Silent Sounds staff) will be invoiced after the event.
  • Delivery or Pick-up – Because we understand that organising an event, function or party is a busy time, Silent Sounds offers you the option to pick-up equipment from one of our locations for free or we will happily deliver the equipment to your nominated address for delivery fee. Additional delivery costs will apply for requests outside of normal business hours and for locations farther than this, and will be provided upon quotation.
  • Equipment booked will be provided for overnight hire. All reasonable efforts will be made by Silent Sounds to have all equipment hired ready for collection or delivered to you on the date you have requested. This will usually be provided the 1-2 days before or day of your nominated booking date. Under these terms and conditions Silent Sounds is not liable for any failure to deliver or delay in delivery for any reason outside of our control.
  • Returning equipment – to ensure we can continue providing Australia with the best audio equipment we need you to ensure all equipment is checked and packed back into the Silent Sounds boxes with the equipment checklist. Equipment is to be returned to Silent Sounds at the agreed time or you must be available on your nominated phone number to arrange collection of equipment. An agreed timeframe will be provided by Silent Sounds via email. If collections are missed, additional hire costs and collection fees may be incurred.

Cancellation, credits and refunds

Our Refund Policy is strictly based on the time a booking cancellation is made. If a booking is cancelled:

a. within 1-3 days of the event date (or scheduled delivery date): no refund or credit will be issued.

b. within 4-7 days of the event date (or scheduled delivery date): a 100% credit note will be issued, strictly no refunds.

c. outside 7 days from the event date (or scheduled delivery date): a 100% credit or refund can be issued

Cancellations at peak times (e.g. public holidays, New Years Eve) require 8 weeks notice, with a 100% termination fee for any cancellations within this time.

1. WARRANTY POLICY

HOW TO ORDER

You can place your order through www.silentsounds.com.au or emailing info@silentsounds.com.au

You will be required to pay for the goods in full at the time of ordering. We use secure payment facilities for online purchases through Stripe or payments can be made via bank transfer. Once your order is complete we will notify you of the dispatch date. If you have any questions regarding specific payment options please don’t hesitate to contact us.

SHIPPING

Orders are usually shipped within 1- 3 weeks after payment based upon product availability. Business days are considered Monday through Friday and exclude all major holidays and any days that our couriers do not ship. We require a physical address for your order; we cannot ship to a PO Box.

MISSING OR DAMAGED ITEMS

Claims for missing or damaged items must be made within 3 days of delivery.

WARRANTY COVERAGE

Should a product require warranty service during this period, Silent Sounds will repair or replace without charge, any part or product proving defective in material or workmanship will have a warranty of 12 months (new equipment) or 6 months (used equipment).

All warranty repairs or services must be performed by an authorised Silent Sounds technician or an approved service facility. The use of non-authorised repair services will render this warranty null and void, and any charges relating to non-authorised repair are the responsibility of the product owner.

WARRANTY EXCLUSIONS

  • Warranty does not cover product failure from; misuse, neglect, accidents, alterations, natural disasters, improper use, paint damage, scratches, water damage and cracks.
  • Failures arising from attempted servicing from a non-authorised Silent Sounds repair facility or technician are excluded from this warranty.

RETURNS

If you are not entirely satisfied with your purchase, we’re here to help. If you have any problems with your product within the first 7 days just send back the product and we will send out a replacement for no charge. We can only accept the return of items that are unused, in their original packaging, with proof of purchase within 7 days of the purchase date. Shipping charges will not be refunded; return shipping costs are at the customer’s expense. You will be responsible for paying for your own shipping costs for returning your item. The original outbound shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

REFUNDS

Once we receive your item, we will inspect it and notify you that we have received your returned item. We will immediately notify you of the status of your refund after inspecting the item. If your return is approved, we will initiate a refund to your bank account within 14 days.

REPAIR PROCESS

We apply for a repair request from our production. When this is received, we send the request and your item to their repairer.
Once in their hands, they will test the product to confirm that it is a manufacturing fault. The supplier will then decide whether to replace or repair the product.
The Item is returned to us after the repair. We then get in touch with you to discuss getting it back in your hands.
If it’s found not to be a manufacturing fault, no fault is found or if they confirm that it is damaged by user error or negligence, charges may apply.

2. WARRANTY CONDITIONS

2.1 Proof of purchase (invoice or paid order confirmation) must be provided when requesting service under its warranty.

2.2 Silent Sounds requires any customer requesting service under the warranties to comply with directions from Silent Sounds staff in relation to troubleshooting any issue and facilitating any repair or replacement under these Warranty Terms and Conditions.

2.3 The Customer is responsible to inspect all goods received from Silent Sounds upon arrival. In instances where goods have been damaged in transit, the Customer must report this to Silent Sounds within 3 days of receipt of the product. Failure to report physical damage on arrival within 3 days of receipt may result in denial of warranty for physical damage.

2.4 Silent Sounds reserves the right to replace the Product or relevant part with the same or equivalent Product or part, rather than repair it. Where a replacement is provided,Silent Sounds will determine, in its discretion, the closest Product within the then current range of Products offered by Silent Sounds with which to replace the faulty or damaged Product. The replacement Product may differ with the replaced Product in size and specifications, at the reasonable election of Silent Sounds. Silent Sounds may replace parts with refurbished parts. Replacement of the Product or a part under the warranty does not extend or restart the warranty.

2.5 If Silent Sounds is unable to repair or replace the Product, the customer will be provided with credit for Silent Sound’s store or may be refunded the price of the Product (at Silent Sound’s election). This credit or refund will be for the amount of the purchase price of the Product excluding the associated Delivery Cost.

2.6 In the event that a replacement, refund, or store credit is provided, the faulty item will become the property of Silent Sounds.

2.7 Where Silent Sounds authorised warranty service of a Product, Silent Sounds will organise for our authorised courier to pick up the Product during business hours (between 9am and 5pm, Monday to Friday) and deliver it to the appropriate authorised repair centre, provided that the Product is safely and securely packaged for safe transport. In this situation Silent Sounds will cover the cost of transport of the serviced Product to and from the Customer.

2.8 Silent Sounds reserves the right to determine which authorised repair centre within Australia is the appropriate service location in any particular circumstance.

2.9 The Product will be at the Customer’s risk while in transit to and from the Silent Sounds Authorised Repair Centre.

2.10 Silent Sounds may seek reimbursement of any costs incurred by Customer where the Product is found to be in good working order.

2.11 Silent Sounds reserves reasonable discretion to determine whether any Product is or is not performing in accordance with Silent Sound’s specifications, subject to applicable law.

3. GENERAL

3.1 Legislation may imply warranties or conditions or impose obligations on Silent Sounds, which cannot be excluded, restricted or modified in relation to consumer goods.

3.2 To the full extent permitted by law, but subject always to clause 3.1, the Standard Warranty and Extended Warranty will not apply in respect of a Product:

(a) If the Product has not been installed, operated, maintained or used in accordance with the manufacturer’s instructions or specifications provided with the Product;

(b) If the factory-applied serial number has been altered or removed from the Product;

(c) To damage, malfunction or failure resulting from alterations, accident, misuse, abuse, fire, liquid spillage, mis-adjustment of customer controls, use on an incorrect voltage, power surges and dips, thunderstorm activity, force majeure, voltage supply problems, tampering or unauthorised repairs by any persons, use of defective or incompatible accessories, the operation of a computer virus of any kind, exposure to abnormally corrosive conditions or entry by any insect, vermin or foreign object in the Product;

(d) To damage arising during transportation, installation or while moving the Product, or to any transportation costs of the Product or any parts thereof to and from the Customer, unless otherwise specified in these Warranty Terms and Conditions;

(e) To any third-party software or hardware not contained in the Product as originally configured by the manufacturer;

(f) To any failure, to the extent that the failure is not a failure of the Product to perform in accordance with its specifications;

(g) To replacement or repair of any consumables (including batteries, projector lamps and cables), or lost parts or accessories;

(h) To service and support of any software operating system or application installed on any Silent Sounds Product, except to assist in restoring the Product to its factory default settings; or

(i) To service of any product whilst it is outside Australia.

3.3 To the full extent permitted by law, but subject always to clause 3.1:

(a) Silent Sounds will not be liable for any loss, damage or alterations to third party hardware, software, programs, data and/or information stored on any media or any part of the Product, no matter how occurring; or for any loss or damage arising from loss of use, loss of profits or revenue, or for any resulting indirect or consequential loss or damage.

(b) Silent Sounds aggregate liability in respect of all claims under the Standard Warranty and Extended Warranty shall not exceed the original purchase price of the Product or, at Silent Sound’s option, the replacement of the Product with a like or similar Product.

(c) Silent Sounds excludes all other warranties, conditions, terms, representations and undertakings whether express or implied.
